'Fermer xo'jaligining yer maydonini maqbullashtirish va uni tugatish tartibi to'g'risida'gi Nizom tasdiqlandi

      O'zbekiston Respublikasi Vazirlar Mahkamasining 2013 yil 31 yanvardagi 22-sonli qarori bilan Fermer xo'jaligining yer maydonini maqbullashtirish va uni tugatish tartibi to'g'risidagi nizom (keyingi o'rinlarda –Nizom) tasdiqlandi.
     Qaror O'zbekiston Respublikasi Prezidentining 2012 yil 22 oktyabrdagi 'O'zbekistonda fermerlik faoliyatini tashkil qilishni yanada takomillashtirish va uni rivojlantirish chora-tadbirlari to'g'risida'gi PF-4478-sonli Farmonini bajarish yuzasidan hamda fermer xo'jaliklarining yer maydonlarini maqbullashtirish jarayonida ularning huquqlari va qonuniy manfaatlariga rioya etilishini ta'minlash, fermer xo'jaliklarini tugatishda qonunchilik normalariga rioya etish kafolatlarining ishonchli tizimini yaratish maqsadida qabul qilindi.
     Nizomning birinchi bo'limida umumiy qoida va tushunchalar belgilab berilgan. Xususan, unda:
• fermer xo'jaligi davlat mulki bo'lgan yer maydonini ijara shartnomasi tuzish asosida uzoq muddatli ijaraga berish, fermer tomonidan tegishli majburiyatlar qabul qilish yo'li bilan tashkil etiladi;
• fermer xo'jaligining yer maydonini maqbullashtirish – yer-suv resurslaridan yanada oqilona foydalanish va fermer xo'jaligining moliyaviy barqarorligini ta'minlash maqsadida uning yer maydoni hajmini o'zgartirish;
• fermer xo'jaligini tugatish – fermer xo'jaligini ixtiyoriylik asosida yoki mazkur Nizom va boshqa qonun hujjatlariga muvofiq tugatish va boshqa tartib-qoidalar o'z ifodasini topgan.
     YER MAYDONINI IXTIYORIY RAVISHDA MAQBULLASHTIRISH
     Nizomning ikkinchi bo'limida fermer xo'jaligi rahbarining tuman (shahar) hokimiga berilgan ariza asosida amalga oshiriladigan fermer xo'jaligi yer maydonini ixtiyoriylik asosida maqbullashtirish (kamaytirish) tartibi belgilangan.
Bunda ixtiyoriylik asosida amalga oshirilgan maqbullashtirishdan so'ng fermer xo'jaligida qolgan yer maydoni O'zbekiston Respublikasining 'Fermer xo'jaligi to'g'risida'gi Qonunida nazarda tutilgan minimal miqdordan kam bo'lmasligi kerak, ya'ni dehqonchilik mahsuloti yetishtirishga ixtisoslashtirilgan fermer xo'jaligi uchun ijaraga beriladigan yer maydonining eng kam o'lchami:
• paxtachilik va g'allachilik uchun – kamida 30 gektar;
• bog'dorchilik, uzumchilik, sabzavotchilik va boshqa ekinlar yetishtirish uchun – kamida 5 gektar bo'ladi.
     Shunga ham e'tibor berish lozimki, fermer xo'jaligi yer maydonini maqbullashtirishda yer maydoni konturlarining yaxlitligi buzilishiga yo'l qo'yilmaydi.
     Ixtiyoriylik asosida fermer xo'jaligi yer maydonini maqbullashtirish Nizomning 1-ilovasidagi sxema bo'yicha amalga oshiriladi.
     Ta'kidlash joizki, fermer xo'jaligini ixtiyoriylik asosida tugatish O'zbekiston Respublikasi Prezidentining 2007 yil 27 apreldagi 'Tadbirkorlik sub'ektlarini ixtiyoriy tugatish va ularning faoliyatini to'xtatish tartibini takomillashtirish to'g'risida'gi PQ-630-sonli qaroriga muvofiq amalga oshiriladi.
     MAJBURIY TARTIBDA MAQBULLASHTIRISH VA TUGATISH
     Yuqoridagi Nizomning uchinchi bo'limida davlat hokimiyati organlari tashabbusi bilan fermer xo'jaligi tomonidan shartnoma intizomi buzilishining hamda xo'jalik faoliyati samarasiz yuritilishining aniqlangan holatlari asosida fermer xo'jaligi yer maydonini maqbullashtirish tartibi belgilangan.
     Xususan, yer maydonini uzoq muddatli ijaraga olish shartnomasini bekor qilish va fermer xo'jaligini tugatish qonun hujjatlarida belgilangan tartibda, mahalliy davlat hokimiyati organlari (tuman (shahar) hokimi) tomonidan taqdim etiladigan da'volar asosida, xo'jalik sudi qaroriga binoan amalga oshirilishi belgilab qo'yilgan.
     Shuningdek fermer xo'jaligini tugatishda mulk huquqi bilan unga qarashli bo'lgan imoratlar, inshootlar yoki ekinlar joylashgan yer maydonini olib qo'yishga faqat qonun hujjatlarida belgilangan hollarda va tartibda yo'l qo'yiladi.
Tuman (shahar) hokimining qarori asosida mulkdorga olib qo'yilgan mol-mulkka teng qiymatli mol-mulk berish va uning ko'rgan zararlarini qoplash yoki mulk huquqi bekor qilinishi tufayli yetkazilgan zararning o'rnini to'liq hajmda qoplash tegishli yer maydonini uni uzoq muddatli ijaraga berish tanlovi natijalari asosida olgan fermer xo'jaligi tomonidan amalga oshiriladi.
     Nizomning 25-bandiga muvofiq, fermer xo'jaligi tomonidan shartnoma intizomining buzilishi va xo'jalik faoliyatining samarasiz yuritilishi aniqlangan holatlar asosida fermer xo'jaligi yer maydonini maqbullashtirish va uni tugatish Nizomning 2-ilovasidagi sxema bo'yicha amalga oshiriladi.
     QARZLARNI TO'LASH
     Nizomning to'rtinchi bo'limi tugatilayotgan fermer xo'jaligining qarzlarini to'lash mexanizmiga bag'ishlangan bo'lib, unga muvofiq, tugatilayotgan fermer xo'jaligining qarzlarini to'lash qonun hujjatlarida belgilangan tartibda amalga oshiriladi.
     Xususan, fermer xo'jaligi ixtiyoriylik asosida tugatilganda uning qarzlarini to'lash tugatuvchi tomonidan O'zbekiston Respublikasi Prezidentining 2007 yil 27 apreldagi 'Tadbirkorlik sub'ektlarini ixtiyoriy tugatish va ularning faoliyatini to'xtatish tartibini takomillashti rish to'g'risida'gi PQ-630-sonli qarori bilan tasdiqlangan Tadbirkorlik sub'ektlarini ixtiyoriy tugatish va ularning faoliyatini to'xtatish tartibi to'g'risidagi nizomga muvofiq amalga oshiriladi.
     Kreditorlarning talablarini to'liq qondirishning imkoni yo'qligi aniqlangan taqdirda tugatuvchi fermer xo'jaligini iqtisodiy nochor (bankrot) deb e'tirof etish to'g'risidagi ariza bilan xo'jalik sudiga murojaat qilishi shart. Fermer xo'jaligi bankrot deb e'tirof etilgan vaqtdan boshlab ixtiyoriy tugatish to'xtatiladi va bundan keyingi tartibot bankrotlik to'g'risidagi qonun hujjatlariga muvofiq amalga oshiriladi, deb xabar beradi Davlat soliq qo'mitasi Axborot xizmati

1.2. Кредитоспособность заемщика определяется на основании его финансовой и кредитной истории, а также текущей финансовой ситуации.
1.3. Для определения кредитоспособности могут быть использованы следующие критерии

To unblock the card, you must contact the bank branch where the card was opened  with your identity document.
SMS notification for the Uzcard card can be activated through an ATM. SMS notification for the Humo card is activated through the bank branch where the card was opened.
You can order all cards in national and foreign currency remotely using the Milliy App.
  • If you have forgotten your card PIN, please come with your identity document to the bank where the card was opened.
  • If you the card (UzCard/HUMO) is lost, you can block it yourself using the Milliy Bank App or call (78) 148-00 10 and ask the operators to block the card.
The identification procedure is carried out remotely, directly in the Milliy application itself. To do this, on the main screen in the application, click on the photo_2023-04-28_11-16-22.jpg icon in the upper left corner, and then select the “Identification” option from the menu and go through all its stages.
  • To change the phone number registered in the Milliy App, please come to the NBU branch which is convenient for you with your identity document.
  • An e-wallet is a system to store funds, as well as transfer money through an app to an account or bank card.

Currently, the NBU offers the following international money transfers: Western Union, MoneyGram, KoronaPay, Asia Express, Contact, Unistream, Swift, as well as Sberbank.
Users of the Milliy Mobile App can receive transfers from Russia using the Sberbank Online service to an electronic wallet in national currency, to an UzCard or HUMO card of the NBU.

The transfer is made in rubles. Upon receipt on an electronic wallet or card, it is automatically converted into UZS. No additional fees are charged.
  • Visa Direct is a service for money transfer using the Milliy Mobile App to more than 50 countries of the world, including Visa cards of Uzbekistan banks.
